Terms of Service
Effective July 6, 2026
These Terms of Service (the “Terms”) govern your use of SyncIEP, a platform for authoring IEPs, monitoring student progress, and managing special-education caseloads (the “Service”). By creating an individual account, you agree to these Terms and to our Privacy Policy. If you are signing on behalf of a school or district as an authorized signer, your organization’s use is governed by the National Data Privacy Agreement (NDPA) it countersigns instead.
1. Your account
You must be an educator or service provider acting in a professional capacity to use the Service. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity under your account. Notify us immediately if you believe your account has been compromised.
2. Authority over student records
The Service stores personally identifiable information from student education records. By using the Service you represent that you are authorized — by your employing school or district, or as otherwise permitted by law — to access and process the student records you bring into your workspace, and that your use complies with the Family Educational Rights and Privacy Act (FERPA), the Individuals with Disabilities Education Act (IDEA), and applicable state student-privacy laws.
3. Ownership of data
Student data belongs to you, your students, and your school — not to us. We claim no ownership of the records, documents, plans, or work product you create or upload. We process student data solely to provide the Service, as described in the Privacy Policy, and never sell it or use it for targeted advertising.
4. Acceptable use
- Access only records you have a legitimate educational reason to access.
- Do not share your account with others; each user needs their own seat.
- Do not attempt to probe, disrupt, or reverse engineer the Service or access another workspace’s data.
- Do not use the Service to violate any law or the rights of any person.
5. AI-assisted drafting
The Service can draft IEP content — present levels, goals, progress narratives — grounded in the evidence in your workspace. AI output is a starting point, not a professional judgment: you and your IEP team remain solely responsible for reviewing, editing, and adopting any drafted content before it becomes part of a student’s plan. The Service records your review and acceptance so authorship stays with the humans on the team.
6. Subscriptions and trials
New accounts begin with a free trial. After the trial, use of the Service requires a paid per-seat subscription. Prices and trial terms are presented at signup and may change with notice; changes never apply retroactively to a period you have already paid for.
7. Termination and data return
You may close your account at any time. On closure — or on expiration of your subscription — you may export your records, and we delete student data on the schedule described in the Privacy Policy, except where law requires longer retention. We may suspend or terminate accounts that materially violate these Terms, with notice where practicable.
8. Disclaimers
The Service is provided “as is.” We do not warrant that it is error-free or uninterrupted, and we do not provide legal advice: compliance features are tools that support your professional obligations, not a substitute for them. To the fullest extent permitted by law, we disclaim all implied warranties.
9. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve months before the claim arose, and neither party is liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited by law.
10. Changes to these Terms
We may update these Terms as the Service evolves. If a change is material, we will notify you by email or in-app notice before it takes effect, and your continued use after the effective date constitutes acceptance. The version you accepted is recorded with your account.
11. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in California, and each party consents to their jurisdiction.
